The warranty period commences from the payment date as specified on the invoice and will continue for the following specified period of time after that date, unless otherwise specified by law, on the Platform (product description page), warranty card/document (which shall be sent with the Product order) or invoice prior to or upon purchase:
The duration of the warranty period, coverage and the terms and conditions of the warranty provided may vary in accordance with the type of electronic device and such details will be mentioned on the product description page (attached to each Product) on the Platform. In the event, as per the laws and regulations of Sri Lanka, you are entitled to a higher warranty period than the warranty period specified herein or in the product description page of the Platform (or invoice), the legally required warranty period will be applicable.
(a) What is not covered under the Thilakma standard limited warranty?
Warranty for electronic Products will be considered invalid for: (a) defects or damage resulting from accident, misuse, abnormal use, abnormal conditions, improper storage, exposure to liquid, moisture, dampness, sand or dirt, neglect, or unusual physical, electrical or electromechanical stress; (b) scratches, dents and cosmetic damage, unless caused by the manufacturer; (c) defects or damage resulting from excessive force or use of a metallic object when pressing on the Product; (d) equipment that has the serial number or the enhancement data code removed, defaced, damaged, altered or made illegible; (e) ordinary wear and tear; (f) defects or damage resulting from the use of Product in conjunction or connection with accessories, products, or ancillary/peripheral equipment not furnished or approved by the manufacturer; (g) defects or damage resulting from improper testing, operation, maintenance, service, or adjustment not furnished or approved by manufacturer, which shall void this limited warranty; (h) defects or damage resulting from external causes such as collision with an object, fire, flooding, dirt, windstorm, lightning, earthquake, exposure to weather conditions, theft, blown fuse, or improper use of any electrical source. Please note that this list above is non-exhaustive and the warranty for electronic Products will be considered invalid for reasons which have not been set out in the above list.
(b) Procedure for claiming warranty
Warranty period and other details will be mentioned either in the warranty card/ document (which shall be sent with the Product order), Platform (in the description of the respective product) or invoice. If the electronic Product is found to be faulty within 7 days of purchase, it will be eligible for immediate replacement provided that it is not considered invalid (as aforesaid in Section 1(a)) and no misuse or tampering of the product is found. The Customer should bring in the Product for warranty claims to the Thilakma Store or courier it for repairs offered by Thilakma, and such a courier fee shall be paid for by the Customer to Thilakma. Upon such a claim Thilakma will conduct an inspection of the Product and decide if the defect is covered under the applicable warranty. If the defect is covered under the warranty conditions, Thilakma will repair and replace (if required, as mentioned below) the electronic Product free of charge (unless the warranty for such a product is to be directly claimed from the manufacturer, as stipulated below). In some instances, Thilakma may request the Customer to visit the Thilakma Store if the electronic Product needs to be tested in front of the Customer. Thilakma requires 7-14 days to inspect and repair/replace the Product. If the parts are not available or otherwise, the time taken can be extended up to 1 month or longer given the condition, complexity and circumstances etc., of the repair. In the event the electronic Product cannot be repaired but falls within the purview of these T&C and the relevant warranty, with no mishandling or damage done by the Customer (and is not invalid as per Section 1(a)), it will be replaced with a new Product by Thilakma (unless the warranty is to be directly claimed from the manufacturer, as stipulated below). Once a Product has been repaired or replaced as aforesaid, the Customer should collect such a Product within 1 month from the Thilakma Store or request for Delivery Services (for an additional delivery fee), or the Product would be disposed of and Thilakma shall bear no responsibility in relation to the same.
In some instances, the warranty for some and not all electronic Products should be directly claimed by the Customers from the manufacturers and this will be notified to you by us (and will be mentioned on the product description page on the Platform), however, upon such notice it shall be the Customers responsibility to claim such a warranty directly from the manufacturer, and Thilakma shall not bear any responsibility or liability in relation to the same. However, Thilakma will assist in directing you to the relevant manufacturer or its relevant agent in Sri Lanka in order for you to claim such a warranty. And in such an event your rights will be against such a manufacturer/agent.
